Membership Terms & Conditions

By registering as a member of Prime Perks or by utilising any Prime Perks benefits such as your card or claiming any Prime Perks member benefits, you agree to enter into, and be bound by, a contract with HBC Management Pty Ltd [ACN 644 819 296] (“We, Us, Our”) and your participation in the Prime Perks program will be governed by these Prime Perks Membership Terms and Conditions.
You agree that you have read and accept the terms of our privacy policy located at https://www.hogsbreath.com.au/privacy-policy/ including without limitation the collection, use and disclosure of personal information. You consent to us, our franchisees, licensees, and business partners contacting you from time to time, including via telephone, post, facsimile and electronic (i.e.. SMS, email, and internet) methods.

Entry

To be part of Prime Perks, you must download the Prime Perks Mobile App and Register an account with a unique email address, which may entitle you to a membership while the Prime Perks Program remains active subject to these terms and conditions.

Prime Perks Benefits

Members earn points on all purchases of qualified items*. Upon reaching a balance of 150 points, your points will be converted into a $15.00 balance for redemption. This will be displayed separately on your app as an accumulated dollar total and an accumulated points total. The displayed points total will never exceed 150 points due to the automatic conversion of points to dollars for redemption. There is no limit to the dollar amount you can accumulate for redemption. Members may redeem their accumulated dollars at any participating Hog’s Breath Cafe restaurant on the settlement of your bill. Prime Perks member benefits are not valid in conjunction with any other offer, promotion or home delivery.

Membership Levels

Blue Level
Earn 0.5 Points per $1 spent on qualified items*.

Silver Level
Earn 1.0 point per $1 spent on qualifying items*.

Platinum Level
Earn 1.25 POINTS per $1 spent on qualifying items*.

Movement between Membership Levels

Blue Level
To maintain blue level no minimum spend is required within the year.

Silver Level
Spend at least $600 in a year to upgrade from Blue level to Silver level. The date for accumulation resets on the day you reach the $600 spend. If you do not maintain a $600 spend within the new year, your membership will revert to Blue level.

Platinum Level
Spend at least $1200 in a year to upgrade from Silver level to Platinum level. The date for accumulation resets on the day you reach the $1200 spend. If you do not maintain a $1200 spend within the new year, your membership will revert to Silver level.

Past Hog’s Squad and Frequent Diners Members

Blue/Black Card Members
All blue/black card members are offered an automatic upgrade to Silver level once your app and email address is registered. begin at this tier once your email address is registered.

Required Conditions to receive the free upgrade to Silver level
Your membership number must have been registered on the blue/black card database. To verify your membership please contact sending your full name, your blue/black card membership number and your existing email address.

Gold Card Members
Required Conditions to receive the gold card benefits
Your membership number must have been registered on the gold card database. To verify your membership please contact sending your full name, your gold card membership number and your existing email address.

Gold Card Benefits
25% discount off food (entrée + main + dessert) for member’s seat.
If multiple entrées, mains, or desserts are designated to the Gold member’s seat, the discount will be applied to the lowest-priced item of that category.
$33.95 Birthday voucher (valid only in the month of member’s birth in the year the voucher is issued).
Birthday voucher is single-use only, and only valid for food items.
If the chosen dish exceeds $33.95 the member simply pays the difference.
Not valid in conjunction with any other offer, promotion or home delivery.
No new members can gain access into this tier.

Definitions

*Qualified items
Full-price food menu items and merchandise purchased within the restaurant. A food item that is a qualifying purchase for a free/discounted item is excluded from earning POINTS (e.g. for a ‘Kids Eat Free’ meal the full price meal valued at $20 or higher must be purchased. Neither the full price meal nor the Kids Eat Free meal earn POINTS).
Kids 12 years and under

General

Beverages are excluded, unless otherwise stated as part of a limited time offering promotion and only for the duration of the promotion.

Prime Perks benefits are not valid in conjunction with any other offer, or home delivery. Some promotional dishes may qualify for Prime Perks benefits/discounts – this will be stated in the terms for that promotion, and we will endeavour to clearly indicate the fact on any promotional material.

Prime Perks members may receive other offers and promotions during the time of their membership, including from partners of Hog’s Breath Cafe.

The minimum age to hold a Prime Perks membership is 18 years.

Prime Perks memberships are valid for use within Australia Hog’s Breath Cafe restaurants only and is not valid with any other promotions (unless otherwise stated), coupons, vouchers, discounts, takeaway (unless otherwise stated), home delivery, $16.90 lunches or other in-store offers.

Discounts and benefits from the card and promotions are for the member nominated on the card only.

Member benefits are personal to you and are not transferable.

We do not exchange or refund member benefits for anything else including cash or gift cards.

Participation is offered at our discretion, and we reserve the right to revoke privileges for any reason.

We reserve the right to change these terms from time to time, and you agree that each time you use our Prime Perks card you accept the terms and conditions, as revised.

A Prime Perks membership entails a digital card and this item is subject to change at our discretion.

Each Prime Perks card is limited to one person only with one unique email address and cannot be used by any person other than the member registered to the Prime Perks card.

A person may only hold one (1) Prime Perks membership at any one time. We reserve the right to terminate multiple Prime Perks memberships held by one person.

Cancellation of your Membership

If you no longer wish to be a member of the Prime Perks program, you can deregister your card by going to the ‘more’ section of the app and clicking the ‘Permanently Delete Account’ By deregistering your card, you will no longer be able to acquire any benefits or eligible to use any benefits, and any accumulated benefits will be lost. If you re-registered it will be recorded as a new membership and you start at a Blue level.

Termination

We reserve the right at any time to give notice to:
Decline to issue Prime Perks cards or provide any Prime Perks membership benefits;
Withdraw or cancel any Prime Perks cards or Prime Perks membership benefits;
Reverse any Prime Perks member benefits;
Terminate your Prime Perks membership of the program; or
Terminate the Prime Perks program.
Because, inter alia:

  • Your abuse or attempt of abuse of your Prime Perks membership, or the benefits associated;
  • You act contrary to these terms and conditions;
  • Any Prime Perks member benefits which are accumulated fraudulently to you or we suspect you have attempted to obtain any Prime Perks benefits fraudulently;
  • you use or attempted to use any Prime Perks benefits for another person other than the cardholder;

Your bankruptcy or death.

Membership may be cancelled/refused to individuals by Hog’s Breath Cafe Management Pty Ltd at its discretion, if Membership is deemed to be fraudulent, linked to a fraudulent Membership and/or a Member engages at any Hog’s Breath Cafe / Hog’s Breath Cafe store and/or to a Hog’s Breath Cafe Management Pty Ltd or Hog’s Breath Cafe / Hog’s Breath Cafe employee in a derogatory, harmful, drunken and/or manner otherwise regarded by Hog’s Breath Cafe Management Pty Ltd as highly inappropriate.

On termination of your membership, we may retain your Prime Perks membership information for record keeping purposes and for general analysis purposes and may allocate to other members any membership.

You agree that we do not need to notify you in advance or give you any reason for any action taken in connection with your membership.

Prime Perks Liability

You acknowledge and agree that there may be:

A delay in issuing you with a digital membership card or non-issue to you of any Prime Perks member benefits;
Acts, errors or admissions by us in the course of providing Prime Perks member benefits;
Suspension and/or termination of the Prime Perks program;
and to the maximum extent permitted by law, we will not be liable to you in any way for any cause in connection with such matters including, without limitation, any unused benefits at the time of your termination, in negligence, contract or otherwise.

Details & Notice

Hog’s Breath Cafe Management may give you notice:

  • By advertisement in a newspaper circulating throughout Australia.
  • by email or SMS (to the last known email address or mobile number provided), which you are taken to have received upon the sender receiving confirmation the message has been sent.
  • By the Hog’s Breath Cafe website (www.hogsbreath.com.au), which you are taken to have received within 5 days of posting on the website.
  • In writing, which you are taken to have received if issued by hand, immediately, or given by post on the earlier of the date of receipt or 3 days after it was sent via post.

You must advise Hog’s Breath Cafe of any change of name, address, or other details as soon as the change occurs. Hog’s Breath Cafe is not responsible for any failure by you to notify Hog’s Breath Cafe of the change that may result in the loss of Prime Perks member benefits and/or any other rewards, prizes, giveaways.

Written proof acceptable to Hog’s Breath Cafe must be supplied for any change of details. Changes to address can be made by contacting Hog’s Breath Cafe via email to . These terms will be construed according to and governed by the laws of Queensland and the parties submit to the exclusive jurisdiction of the courts in Queensland.
