Hog’s Squad Membership Terms & Conditions

  1. By registering as a member of Hog’s Squad or by utilising any Hog Squad benefits such as your card or claiming any Hog’s Squad member benefits, you agree to enter into, and be bound by, a contract with Hogs Breath (Australia) Pty Ltd [ACN 071 132 655] (“We, Us, Our”) and your participation in the Hogs Squad program will be governed by, these Hog’s Squad Membership Terms and Conditions.
  2. You agree that you have read and accept the terms of our privacy policy located at http://www.hogssquad.com/privacypolicy including without limitation the collection, use and disclosure of personal information. You consent to us, our franchisees, licensees, and business partners contacting you from time to time, including via telephone, post, facsimile and electronic (ie. sms, email and internet) methods.

Payment

  1. To be part of Hog’s Squad, you must pay a one-off fee of $19.90 per card, which may entitle you to a lifetime membership while the Hog’s Squad Program remains active subject to these terms and conditions.

Hog’s Squad Benefits

  1. Our Hog’s Squad benefits include:
  • Swipe/scan your Hog’s Squad card anytime at any Hog’s restaurant in Australia and New Zealand when dining and you will be rewarded with a 25% discount off your main meal unless otherwise specified.
  • Swipe/scan you Hog’s Squad card at a Hog’s Express and get 15% off your burger or salad unless otherwise specified.
  • Receiving one complimentary birthday voucher valid for use in the month of your birthday, in the year you receive the voucher. Voucher entitles the card holder to a free Natural or Blackened Prime Rib Steak in a traditional cut size or choose your own masterpiece from our menu to equal or lesser value. Maximum value must not exceed $33.95. Offer does not include mega cut sized steaks. Offer not valid with any other offer or discount for the card holder. Limited to one complimentary birthday meal per person, per annum. You consent to us posting or emailing birthday vouchers which state your name, address, birth month and year of validity.
  • Hog’s Squad members may receive other offers and promotions during the time of their membership, including from partners of Hog’s Australia’s Steakhouse.

Kids 12 years and under

  1. Kids 12 years of age and under are eligible to hold a Hog’s Squad Card and receive:
    1. When they purchase a main meal, 25% off their main meal purchased from our Kids Menu, a free drink and a kid’s ice cream; and
    2. a birthday card and can only choose their free birthday meal from our Kids Menu including a drink and kids ice cream.

Hog’s Squad Conditions

  1. Hog’s Squad cards are valid for use within Australia and New Zealand Hog’s Australia’s Steakhouse restaurants only and is not valid with any other promotions, coupons, vouchers, discounts, home delivery, $9.90 lunch dishes ($12.90 lunch dishes in NZ) or other in-store offers.
  2. Replacement cards will incur an administration cost.
  3. Discounts and benefits from the card and promotions are for each member nominated on the card only.
  4. Hog’s Squad cards joined with a unique email address will only receive a birthday card if they join more than 16 days prior to their birthday.
  5. Member benefits are personal to you and are not transferable.
  6. We do not exchange or refund member benefits for anything else including cash or gift cards.
  7. Participation is offered at our discretion and we reserve the right to revoke privileges for any reason.
  8. We reserve the right to change these terms from time to time, and you agree that each time you use our Hog’s Squad card you accept the terms and conditions, as revised.
  9. A Hog’s Squad membership entails both a physical and digital card and both items are subject to change at our discretion.
  10. Each Hog’s Squad card is limited to one person only with one unique email address and cannot be used by any person other than the member registered to the Hog’s Squad card.
  11. A person may only hold one (1) Hog’s Squad or Frequent Diner membership at any one time. We reserve the right to terminate multiple Hog’s Squad or Frequent Diner memberships held by one person.

Cancellation of your Hog’s Membership

  1. If you no longer wish to be a member of the Hogs Squad program, you can deregister your card by contacting us on 1800 464 783 (AUS) or 0800 464 783 (NZ). By deregistering your card, you will no longer be able to acquire any benefits or eligible to use any benefits.

Termination

  1. We reserve the right at any time to give notice to:
    1. (a) Decline to issue Hog’s Squad cards or provide any Hog’s Squad membership benefits;
    2. (b) Withdraw or cancel any Hog’s Squad cards or Hog’s Squad membership benefits;
    3. (c) Reverse any Hog’s Squad member benefits;
    4. (d) Terminate your Hog’s Squad membership of the program; or
    5. (e) Terminate the Hog’s Squad program.
  1. Because, inter alia:
    1. (a) your abuse or attempt of abuse of your Hog’s Squad membership, or the benefits associated;
    2. (b) you act contrary to these terms and conditions;
    3. (c) any Hog’s Squad member benefits which are accumulated fraudulently to you or we suspect you have attempted to obtain any Hog’s Squad benefits fraudulently;
    4. (d) you use or attempted to use any Hog’s Squad benefits for another person other than the cardholder;
    5. (e) Your bankruptcy or death.
  2. Membership may be cancelled/refused to individuals by Hog’s Breath Cafe (Australia) Pty Ltd at its discretion, if Membership is deemed to be fraudulent, linked to a fraudulent Membership and/or a Member engages at any Hog’s Breath Cafe / Hog’s Australia’s Steakhouse store and/or to a Hog’s Breath Cafe (Australia) Pty Ltd or Hog’s Breath Cafe / Hog’s Australia’s Steakhouse employee in a derogatory, harmful, drunken and/or manner otherwise regarded by Hog’s Breath Cafe (Australia) Pty Ltd as highly inappropriate.
  3. On termination of your membership, we may retain your Hog’s Squad membership information for record keeping purposes and for general analysis purposes and may allocate to others members any membership.
  4. You agree that we do not need to notify you in advance or give you any reason or any action taken in connection with your membership.

Hog’s Squad Liability

  1. You acknowledge and agree that there may be:
    1. (a) A delay in issuing you with a card or non-issue to you of any Hog’s Squad member benefits;
    2. (b) Delay in, or non-replacement of a lost, stolen or damaged Hog’s Squad card;
    3. (c) Acts, errors or admissions by us in the course of providing Hog’s Squad member benefits;
    4. (d) Suspension and/or termination of the Hog’s Squad program;
  2. and to the maximum extent permitted by law, we will not be liable to you in any way for any cause in connection with such matters including, without limitation, any unused benefits at the time of your termination, in negligence, contract or otherwise, and any liability shall be limited to a refund of the membership fee.

Details & Notice

  1. Hog’s Australia’s Steakhouse may give you notice:
    • by advertisement in a newspaper circulating throughout Australia;
    • by email or sms (to the last known email address or mobile number provided), which you are taken to have received upon the sender receiving confirmation the message has been sent;
    • by the Hog’s Australia’s Steakhouse website (www.hogsbreath.com.au) or www.hogssquad.com, which you are taken to have received within 5 days of posting on the website; or
    • in writing, which you are taken to have received if issued by hand, immediately, or given by post on the earlier of the date of receipt or 3 days after it was sent via post.
  1. You must advise Hog’s Australia’s Steakhouse of any change of name, address, or other details as soon as the change occurs. Hog’s Australia’s Steakhouse is not responsible for any failure by you to notify Hog’s Australia’s Steakhouse of the change that may result in the loss of Hog’s Squad member benefits and/or any other rewards, prizes, giveaways.
  2. Written proof acceptable to Hog’s Australia’s Steakhouse must be supplied for any change of details. Changes to address can be made by contacting Hog’s Australia Steakhouse on 1800 464 783 (AUS) or 0800 464 783 (NZ) or via email to hogssquad@hbca.com.au. These terms will be construed according to and governed by the laws of Queensland and the parties submit to the exclusive jurisdiction of the courts in Queensland.

Gold Hog’s Squad Card Holders

Should you be one of our privileged original Gold Card holders and have any questions relating to terms and conditions please contact us directly hogssquad@hbca.com.au or via 1800 HOGSTER or if in NZ 0800 HOGSTER. Gold Card members are entitled to 25% off the card holders Hog-etiser, Main Meal and Dessert. Discount for Gold Card member only. Member must present card to receive discount. Gold Hog’s Squad cards are valid for use within Australia and New Zealand Hog’s Australia’s Steakhouse restaurants only and is not valid with any other promotions, coupons, vouchers, discounts, home delivery, $9.90 lunch dishes ($12.90 lunch dishes in NZ) or other in-store offers.

Refund Policy

If you are not completely satisfied with your purchase of the Hog’s Squad membership within 30 days, in addition to your rights as a consumer under the Competition and Consumer Act and other applicable Australian consumer protection laws and regulations, you may be eligible to a refund of the membership fee.

A request for refund needs to be submitted in writing to hogssquad@hbca.com.au, refunds can be requested within 30 days of receiving your Hog’s Squad card. Once your request is received and investigated a refund can be initiated on the receipt of your Hog’s Squad membership card to P O Box 8068, Cleveland, Queensland, 4163.

If you paid by credit or debit card, refunds will be sent to the card-issuing bank within three (3) business days of receipt of the returned Hog’s Squad card at P O Box 8068, Cleveland, Queensland, 4163.
Please contact your bank for any further questions regarding to your refund.

 


Frequent Diner Card Membership Terms and Conditions

  1. By activating your Frequent Diner Card you confirm you have reviewed, understood and agree to our Frequent Diner Membership Terms and Conditions.
  2. We reserve the right to change these terms from time to time, and you agree that each time you use our Frequent Diner Card you accept the terms and conditions.
  3. Participation is offered at the discretion of Hog’s Breath Cafe, management reserves the right to revoke privileges for any reason.
  4. Membership to Hog’s Breath Cafe Frequent Diner Program entails a fee of $50 for a 5 year membership or free cards can be redeemed by dining 6 times and collecting a stamp per visit to a Hog’s Breath Cafe restaurant.
  5. The Frequent Diner Cards are not debit, credit or charge cards, are not transferable and remain the property of Hog’s Breath Cafe.
  6. Frequent Diner Cards are not valid for use in conjunction with any other offer, promotion or discount, including $9.90 lunch dishes and items available for delivery.
  7. Replacement cards will incur an administration cost.

  14. From time to time Hog’s Breath Cafe may send you offers from partners of Hog’s Breath Cafe.
  15. Each Frequent Diner Card is limited to one person only with one unique email address and cannot be used by any person other than the member registered to the Frequent Diner Card.
  16. A person may only hold one (1) Frequent Diner membership at any one time. We reserve the right to terminate multiple Frequent Diner memberships held by one person.
  17. Government email addresses can filter out junk mail. If you register with a government email address you may not be able to receive promotion emails from Hog’s Breath Cafe including your birthday voucher.
  18. Membership may be cancelled/ refused to individuals by Hog’s Breath Cafe at its discretion, if membership is deemed to be fraudulent, linked to a fraudulent membership and/or a member engages at any Hog’s Breath Cafe restaurant and/or to a Hog’s Breath Cafe or Hog’s Breath Cafe employee in a derogatory, harmful, drunken and/or manner otherwise regarded by Hog’s Breath Cafe as highly inappropriate.
  19. Hog’s Breath Cafe reserves the right to terminate our Frequent Diner Member program at any time by giving you at least 30 days prior written notice in which case you will cease to be able to use and/or participate within our Frequent Diner program and Hog’s Breath Cafe shall have no further liability.
  20. Except as provided in any law which cannot lawfully be excluded or modified by agreement, Hog’s Breath Cafe does not accept any liability whatsoever, including for negligent acts and omissions, with respect to:
    • the breach of any of these terms or any term implied by law (including statute) by any person other than Hog’s Breath Cafe.
    • any Frequent Diner membership benefit or other reward, prize or giveaway;
    • any death or injury or consequential loss or damage arising from the supply of a  Frequent Diner membership benefit and/or other reward, prize, giveaway;
    • the loss, theft or destruction of our Frequent Diner Card or any other member benefit or other reward, prize, giveaway;
    • any failure, delay or inability to provide our Frequent Diner Card or other member benefit or other reward, prize, giveaway to you caused by circumstances beyond its control, including strikes or industrial disputes, acts of God, flood, weather, war or civil disturbance; and
    • any other liability, loss or damage incurred or suffered by any Member (or any other person) in connection with Hog’s Breath Cafe Frequent Diner membership.
  21. Hog’s Breath Cafe may give you notice:
    • by advertisement in a newspaper circulating throughout New Zealand;
    • by email or sms (to the last known email address or mobile number provided), which you are taken to have received upon the sender receiving confirmation the message has been sent;
    • by the Hog’s Breath Cafe website (www.hogsbreath.co.nz), which you are taken to have received within 5 days of posting on the website; or
    • in writing, which you are taken to have received if issued by hand, immediately, or given by post on the earlier of the date of receipt or 3 days after it was sent via post;

  29. Membership to Hog’s Breath Cafe Frequent Diner Program entails a fee of $50 for a 5 year membership for kids or free cards can be redeemed by dining 6 times and collecting one stamp per visit to a Hog’s Breath Cafe restaurant. Stamps may only be collected by purchasing a full value kids meal and is not valid with Kids Eat Free.

Hog’s 12 Days of Christmas Competition T&C’s

To enter Eligible Entrants must, during the Promotional Period.  Simply state in 25 words or less why this Christmas is so important toyou.

The total competition period commences on 11/12/2017 at 12:01 AM and closes 22/12/2017 at 8:15 PM (‘Promotional Period‘). The competition consists of daily individual prize draws. Gift Vouchers

Terms of Use for HOG’S Gift Vouchers (AUS & NZ):

1. By purchasing, redeeming or attempting to redeem a Gift Voucher, you accept and agree to be bound by these Terms of Use and acknowledge you have read and understood our Privacy Policy, available at http://www.hogsbreath.com.au/privacy-policy/
2. Gift Vouchers can be purchased in Australian Dollars (AUD) and New Zealand Dollars (NZD) only.
3. Gift Vouchers purchased in Australian Dollars can only be redeemed in Australian Dollars.
4. Gift Vouchers purchased in New Zealand Dollars can only be redeemed in New Zealand Dollars.
5. Gift Vouchers can be made out to any denomination up to and including the value of $500.
6. The Gift Voucher can be used for purchases at any Hog’s Breath Cafe restaurant located throughout Australia and New Zealand only.
7. The Voucher is valid for bookings made within 6 months from the date of issue unless otherwise stated on the Gift Voucher. The Gift Voucher will expire at midnight on the expiry date stated on the front of the Gift Voucher and cannot be extended.
8. If there is any credit remaining after redemption of the Gift Voucher, it can be used towards future purchases until the credit balance reaches zero, in the form of a new Gift Voucher only.
9. Any balance that remains on the Gift Voucher after the expiry date is not available for use.
10. Additional values cannot be added to existing Gift Vouchers.
11. You cannot use the Gift Voucher for the sole purpose of purchasing alcohol and/or in such a way which would result in a breach of the Liquor Licensing Laws or any other laws governing the Hog’s Breath Cafe where you use the Gift Voucher.
12. You are responsible for the use and safety of your Gift Voucher and the Gift Voucher will not be replaced if lost, stolen, altered or damaged.
13. You are liable for all transactions on your Gift Voucher, except to the extent to which there has been fraud or negligence by us or by any of our employees.
14. Gift Vouchers are non-refundable and cannot be exchanged for cash.
15. To the extent permitted by law, we reserve the right to amend these Terms of Use at any time. Changes to the Terms of Use will be available at http://www.hogsbreath.com.au/terms-conditions/
16. These Terms of Use are to be construed and enforced in accordance with the laws of Queensland, Australia. Any dispute arising from your receipt or use of the Voucher is exclusively subject to the jurisdiction of the courts of Queensland, Australia.

Tell us why you Head to Hog’s TV Commercial Promotion – Terms & Conditions

1) This promotion is being conducted according to these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2) Entry is only open to Hog’s Breath Cafe (Australia) Pty Ltd, Hog’s Squad or Frequent Diner members located in the geographical region from Rockhampton to Byron Bay and west to Toowoomba who have been selected from our database. No entries from customers, guests or the general public will be accepted. If you are under the age of 18 entry must be made by a parent or guardian over the age of 18, a legal resident of Australia and, if selected the guardian would be expected to be able to supply documents proving this.

3) Promotion commences at 9am AEST on the Friday 3rd November 2017 and closes at 5pm AEST on Friday 17th November 2017 (“Promotion Period”).

4) To be eligible to enter, applicants must:

Upload a short front facing video from their mobile phone telling us “Why you Head to Hog’s?”

5) Videos must be original and authentic and cannot be sourced or replicated from a third party (including from the internet).

6) You agree that the Promoter, or its agents, may contact you for a telephone interview and any follow up contacts involved in the selection process. Such contacts do not indicate the applicant has been successful. All successful applicants will be informed in writing.

7) The Promoter reserves the right, at any time, to verify the validity of entries and applicants (including an applicant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of this process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Promoter reserves the right to reject any entry and disqualify any applicant from participating in this promotion without assigning any reason. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

8) If there is a dispute as to the identity of an applicant, the Promoter reserves the right, in its sole discretion, to disqualify the entry or applicant.

9) The Promoter’s decision relating to this promotion are final and binding upon applicants and will be accepted without demur or objection. No correspondence will be entered into.

10) Applicants or the guardian with a child, if the selected spokesperson is a child, should be available at a location to be agreed for 1 day in December or January 2017 (exact date to be notified and agreed).

11) Successful applicants who appear in our brand campaign will receive $600 Hoggie Dollars to spend at Hog’s at the completion of the Shoot.

12) Applicants agree that they are fully responsible for all Content they submit to the Promoter via the promotion. All Content submitted must be appropriate for general viewing.

13) Applicants warrant and agree that:

they will not submit any Content that is unlawful or fraudulent, or that is in breach of any intellectual property, privacy, publicity or other rights, defamatory, indecent, obscene, derogatory, voyeuristic, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, of individuals protected by a court order, not suitable for children aged under 15, or otherwise unsuitable for publication;

their Content shall not contain viruses or cause injury or harm to any person or entity;

they created the Content or hold the necessary rights (for example copyright) required to submit the Content and they will obtain full prior consent from any person who has jointly created or has any rights (including copyright or other intellectual property rights) in the Content to the uses contemplated by these Terms and Conditions;

the Content does not infringe the rights (including intellectual property rights) of any third party;

any images must be non-professional and must not have been previously published or won any awards;

they consent to any use of the Content by the Promoter, its affiliates and sub-licensees which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth), or the applicant has obtained such consent from the moral rights holder. This means, for example, that the Promoter is able to use and amend the Content for its own promotional purposes; and, may use the Content without attributing the applicant, or any third party, as the author of the Content;

The applicant is not represented by any third-party agency for the provision of services as contemplated by this Promotion;

The applicant has no current criminal records; and,

they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.

As a condition of entering this promotion, each applicant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (including the Content) and any material produced or created as a result of the Shoot, for the purpose of promoting this promotion (including any outcome) including on the Promoter’s social media accounts.

The Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:

to disqualify any entrant; or

to modify, suspend, terminate or cancel the promotion, as appropriate.

Nothing in these Terms and Conditions is intended to exclude, restrict or modify rights which you may have under any law (including the Australia Consumer Law (‘ACL’), and any consumer guarantees relating to goods or services under the ACL) which may not be excluded, restricted or modified by agreement (‘Your Consumer Rights’). Subject to Your Consumer Rights, the promoter is not liable for any loss or damage however caused (including by negligence), suffered or incurred in connection with this promotion.

General

  1. Information on how to enter and prizes form part of the Terms and Conditions of Entry. Entry into this competition is deemed acceptance of these Terms and Conditions.
  2. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.

 

Who can enter

  1. Subject to the clauses below, entry is open to all residents of Australia who have fulfilled the requirements set out below (‘Eligible Entrants‘). Entrants must be over the age of 18, as of the date of entry.
  2. Employees, and their immediate families, of the Promoter, associated agencies and companies, contractors or individuals are not eligible to enter this competition. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin.

How to enter

  1. To enter Eligible Entrants must, during the Promotional Period (defined below):
    • Simply state in 99 words or less which dish you would choose and why from our new $9.90 lunch menu
  2. By submitting an entry into this competition entrants consent to receive promotional and other marketing messages from the Promoter (including messages sent electronically for an unlimited period of time). Entrants will be able to opt-out at any time by following the instructions included in each message sent by the Promoter.
  3. Entries must provide contact details on request to be eligible to win. Entrants may only enter in their own name. Inaudible, incomprehensible, illegible, and incomplete entries may be deemed invalid.

 

Number of Entries permitted

  1. One entry per Eligible Entrant.

 

Open, Close, Draw and Publish dates

  1. The competition commences on 04/12/2017 at 12:01 AM (AEDST) and closes 10/12/2017 at 12:00 AM (Midnight – AEDST) (‘Promotional Period‘). All times noted in these Terms and Conditions are local times, based on the location of the Promoter. If any draw date falls on a public holiday, as defined in the state of the Promoter, that draw will be conducted on the next business day. Entries must be received by the Promoter prior to the competition close date and time.
  2. The winners will be the first valid entries drawn at –

  1. The winners will be notified by Personal Message via Facebook Messenger within two business days of the draw.
  2. Prizes must be claimed within 7 days.

The Promoter may conduct such further draws on 12/12/2017 (at 11:00am at Hog’s Support Office, L1, 152 Shore Street, Cleveland, QLD, 4163.) as the original draw in order to distribute any prizes unclaimed by this date, subject to State and Territory legislation. Winners of any further draws will be notified by Personal Message via Facebook Messenger within two business days of the draw.

Further Terms and Conditions

  1. Any entrant found to have used a third party (including online competition entry site) to enter on their behalf will have all entries invalidated and any claim they have to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any prize awarded. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request. The Promoter reserves the right to disqualify any entrant who provides false information or who seeks to gain an unfair advantage or to manipulate this competition.
  2. Any entrant found to be entering incorrect contact details, including incorrect email contact details, will have all entries invalidated and any claim to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any prize awarded. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
  3. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. Cash will not necessarily be awarded as a substitute. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
  4. The Promoter highly recommends a current residential street address be provided when requested for ease of correspondence and potential prize delivery. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner.
  5. The Promoter reserves the right to request winners to sign a winner’s deed of release (and indemnification) or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
  6. The Promoter reserves the right to conduct a redraw in the event that an entrant, claiming to be a winner, is unable to satisfy these Terms and Conditions or has breached these Terms and Conditions.
  7. The Promoter’s decision in relation to any aspect of the competition is subject to State and Territory legislation but also final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to the winner’s nominated address as stated in their original entry. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.

Copyright, Statutory guarantees, Waiver and liability

  1. All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received.
  2. In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to granting the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use.
  3. Prize-winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.
  4. The Promoter (subject to State and Territory legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition. In particular, computer generated entries and the use “scripting” is not permitted and will not be accepted.
  5. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees‘).

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize The Promoter (including its’ officers, employees and agents) excludes all liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or opportunity), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition including taking or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), including the Non-Excludable guarantees. Any change in value of the prize occurring between the publishing date and date the prize is claimed is not the responsibility of the Promoter.
